Terms of Service

These terms govern your use of ProTech IT Solutions' website and the provision of IT services. Please read them carefully.

1. Agreement to Terms

By accessing our website or engaging ProTech IT Solutions Pty Ltd (ABN 89 655 365 576) for any services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

These terms apply to all visitors, clients, and others who access or use our services.

2. Services Description

ProTech IT Solutions provides the following categories of professional IT services to Australian businesses, schools, and organisations:

  • Managed IT Support - remote helpdesk, system monitoring, patch management, M365 administration, and cloud backup management
  • Cybersecurity & Compliance - Essential Eight alignment, threat monitoring, EDR, email security, and VPDSF/Privacy Act readiness
  • Digital Forensics & Incident Response (DFIR) - breach containment, memory and host forensics, M365 forensics, and court-ready reporting
  • Penetration Testing - external/internal network testing, web application assessments, and social engineering simulations
  • Hardware & On-Site Support - component repairs, device procurement, fleet deployment, and structured cabling
  • Strategic IT Consulting - vCIO advisory, IT roadmaps, disaster recovery planning, and technology vendor reviews

The specific scope, deliverables, and fees for each engagement are defined in a separate Service Agreement or Statement of Work agreed between the parties.

3. Use of Our Website

You agree to use our website only for lawful purposes. You must not:

  • Submit false, misleading, or fraudulent information via any form on this website
  • Attempt to probe, scan, or test the vulnerability of our website or systems without written authorisation
  • Use our website in any way that violates applicable Australian federal or state laws
  • Attempt to gain unauthorised access to any part of our website or associated infrastructure

4. Payment Terms

Payment terms for managed IT services and project-based engagements are detailed on our Pricing page and within individual service agreements. Unless otherwise agreed in writing:

  • Managed IT plans are invoiced monthly in advance
  • Project-based services (e.g. penetration testing, DFIR) may require a deposit prior to commencement
  • All prices are in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise
  • Invoices are due within 14 days of the invoice date
  • Late payments may incur interest at the rate of 2% per month on the outstanding balance

5. Intellectual Property

All content on this website - including text, graphics, logos, icons, and software - is the property of ProTech IT Solutions Pty Ltd or its content licensors and is protected by Australian and international intellectual property laws.

Reports, documentation, and deliverables produced by ProTech IT during an engagement remain our intellectual property until full payment is received, at which point ownership transfers to the client as specified in the relevant service agreement.

You must not reproduce, distribute, modify, or create derivative works from our website content without our prior written consent.

6. Limitation of Liability

To the maximum extent permitted by law (including the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth)):

  • ProTech IT Solutions is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website
  • Our total aggregate liability for any claim arising out of or relating to these terms or our services is limited to the amount paid by you for the specific service giving rise to the claim in the three months preceding the incident
  • We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components

Nothing in these terms excludes, restricts, or modifies any rights or guarantees implied by the Australian Consumer Law that cannot lawfully be excluded.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of an engagement. This obligation survives the termination of any service agreement. Confidentiality obligations specific to each engagement are detailed in the relevant service agreement or non-disclosure agreement.

8. Termination

Either party may terminate a managed IT service agreement by providing 30 days' written notice, unless otherwise specified in the service agreement. ProTech IT may terminate services immediately if you breach these terms or any applicable service agreement and fail to remedy the breach within 7 days of written notice.

9. Governing Law

These Terms of Service are governed by the laws of the State of Victoria, Australia. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

10. Changes to These Terms

We reserve the right to update these Terms of Service at any time. Continued use of our website or services after any changes constitute your acceptance of the revised terms.
